1. Acceptance of Terms

By accessing or using the KitoPro.ai platform ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and KitoPro.ai ("we," "us," or "our").

2. Eligibility

You must be at least 16 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement and are legally capable of entering into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

3. Account Registration

To access most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activities that occur under your account.
• Not share your account credentials with others or create accounts on behalf of others without authorization.

4. Description of Service

KitoPro.ai provides an AI-powered IT training platform that includes:

• Hands-on training labs across IT and cybersecurity domains with AI evaluation.
• Interview preparation tools with question libraries and AI coaching sessions.
• Progress tracking, performance analytics, and skill assessment.
• Digital certificates for completed and passed labs (Pro and Enterprise plans).
• Admin dashboards for team management (Enterprise plan).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Infringe upon intellectual property rights of others.
• Upload or transmit viruses, malware, or harmful code.
• Attempt to gain unauthorized access to systems, data, or accounts.
• Use automated tools (bots, scrapers) to extract data without permission.
• Harass, abuse, or harm other users.
• Manipulate AI evaluation scores or circumvent platform restrictions.
• Share, resell, or redistribute access to the Service without authorization.
• Use the Service for any illegal, fraudulent, or unauthorized purpose.

6. Subscriptions and Payments

The Service offers paid subscription plans (Starter, Pro, Enterprise). By subscribing, you agree to:

• Pay all applicable fees as described on the pricing page.
• Provide valid payment information through our authorized payment processor.
• Authorize recurring billing at the chosen interval (monthly or annual).
• Understand that fees are non-refundable except as required by law or stated in our refund policy.
• Notify us at least 30 days before renewal to cancel and avoid future charges.
• Accept that we may change pricing with at least 30 days' notice before the next billing cycle.

7. Free Trial

We offer a 7-day free trial on select plans. The trial allows access to a limited set of features. You may cancel during the trial period at no charge. If you do not cancel before the trial ends, your selected plan will begin and your payment method will be charged.

8. AI Evaluation and Feedback

The AI evaluation provided by the Service is intended for educational and training purposes only. AI-generated scores, feedback, and assessments do not constitute professional certification, official academic evaluation, or guaranteed job placement. We do not warrant the accuracy or completeness of AI-generated evaluations. You acknowledge that AI may produce inaccurate or incomplete results and should use your own judgment.

9. Certificates

Digital certificates are issued for labs passed with a score of 70 or above on Pro and Enterprise plans. Certificates are non-transferable and are tied to your account. We reserve the right to revoke certificates obtained through fraudulent means, cheating, or violation of these Terms. Certificates indicate completion of a training lab and do not constitute official industry certification.

10. Intellectual Property

All content on the Service, including labs, scenarios, questions, evaluations, software, logos, and design, is the property of KitoPro.ai or its licensors and is protected by intellectual property laws. You may not:

• Copy, reproduce, or distribute our content without permission.
• Modify, reverse-engineer, or create derivative works from the Service.
• Use our trademarks, logos, or branding without authorization.
• Extract or scrape lab content, questions, or evaluation data.

Your submissions (answers, practice responses) remain your property, but you grant us a license to process and evaluate them for the purpose of providing the Service.

11. User Content

You are solely responsible for any content you submit to the Service. You represent that you have the rights to any content you upload and that it does not violate any laws or third-party rights. We may remove content that violates these Terms or is otherwise objectionable.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Please review our Privacy Policy for details.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not liable for any outcomes resulting from the use of AI evaluations, including employment decisions, academic assessments, or professional judgments made based on our feedback.

14. Limitation of Liability

To the maximum extent permitted by law, KitoPro.ai and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless KitoPro.ai, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of third-party rights.

16. Termination

You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees, or engage in fraudulent or harmful activity. Upon termination, your right to use the Service ends immediately. We may delete your data after a reasonable period, subject to legal retention requirements.

17. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

18. Changes to Terms

We may update these Terms at any time. We will notify users of significant changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
